Section 871 of the John S. McCain National Defense Authorization for Fiscal Year 2019 (Public Law 115-232) prohibits procurement of neodymium iron boron (NdFeB) and samarium cobalt (SmCo) magnets as well as some forms of tungsten from China, Russia, North Korea & Iran. The Department of Defense has implemented these requirements in the Defense Federal Acquisition Regulation Supplement (DFARS). This presentation will highlight the tiers of the rare earth element supply chain whereas the new restrictions apply. The presentation will also broadly discuss the Presidents’ July 22, 2019 authorization of the Defense Production Act Title III program for mitigating defense supply chain risks for rare earth elements. In general, the Title III program provides the President broad authority to ensure the timely availability of essential domestic industrial resources to support national defense and homeland security requirements through the use of highly tailored economic incentives.
